Legal Aid at Canter Levin & Berg

At Canter Levin & Berg Solicitors, we currently offer legal aid funded legal services to clients in our Family Law department and our Criminal Law department.

Family Law

The introduction of the Legal Aid, Sentencing and Punishment of Offenders Act, which came into force on 1st April 2013, limited the availability of legal aid funding to those who fulfil very specific criteria.

This means that legal aid funding is no longer available for certain types of family law cases, for example divorce proceedings (except where there have been allegations of domestic abuse or where the marriage is a forced marriage).

Our family law department now offers legal aid in the following situations;

  • Care proceedings, when social services become involved with a family and where they might wish to have the children taken into care.
  • Family law cases where the person seeking legal help is the victim of domestic violence or has been threatened with violence by a family member.
  • Child law cases involving allegation of child abuse, or where a child has been abducted by a family member.
  • Representation of a child during legal proceedings.
  • Injunctions, such as those preventing a parent from taking a child out of the country.
  • Dealing with forced marriages, including obtaining forced marriage protection orders.

Criminal Law

In terms of Criminal Law, the Legal Aid, Sentencing and Punishment of Offenders Act also limited the availability of legal aid for people who are already in prison but who might need help from a solicitor.

For those seeking legal aid to defend themselves from an allegation at either the magistrates’ court or the Crown Court, legal aid funding is still available, however there are strict financial means tests which decide if you can claim legal aid and what level of legal aid you are entitled to receive.
